Abstract
"Legal representation is the thin line which can separate mere accusation from the serious consequences that flow from criminal conviction. Representation for the accused has been a right given slowly, and always within limitations. However, a person who is denied counsel is given grounds for grievance and resentment, even if guilty of the offence charged, and thereby comes closer to further conflict with the criminal process.

Legal Aid in the Criminal Courts examines the performances of lawyers acting within the terms of the extraordinary legal aid plan in Ontario, which seeks to provide counsel on the same basis as that received by those who pay privately for legal representation. For the many steps toward the final disposition of criminal cases in the courts, Professor Wilkins compares systematically the work of legal aid lawyers with those of lawyers retained privately; he also discusses differences between cases with legal representation and those in which the accused is not represented, within the difficult circumstances of the lower courts in urban Toronto. The author is attentive to the relationships of various legal aid programs in the UK and the US to the Ontario Plan, and to the adaptations of practising lawyers to the Ontario system.

Legal aid has been considered and evaluated both as a principle and as a right. This work is unique as an extensive examination of how it actually operates in the crucible of the Court. (Canadian Studies in Criminology 3).
