Abstract
"The focus of the inquiry reported is the flooding of, and damages to, the reserve lands of eight First Nations in the Qu'Appelle Valley in southern Saskatchewan following creation of water control structures in the early 1940s. This report begins with background information on the claim being examined in the inquiry and on the history of the Qu'Appelle Valley treaties, selection of reserves, development of agrarian economies by the First Nations, water development and control operations in the Valley, band council resolutions taken in 1977 regarding compensation for flooding, and the creation of the Qu'Appelle Valley Indian Development Authority. Issues considered in the inquiry are then analyzed and the resulting findings and recommendations are presented. The issues include interpretation of Section 34 of the Indian Act, Canada's fiduciary obligations and its obligations under Treaty 4, effects of the 1977 band council resolutions, and water rights."--WorldCat.org.
