Abstract
"This report deals with the inquiry into the creation & implementation of what has come to be known as the File Hills Scheme on the reserve of the Peepeekisis First Nation in Saskatchewan. The Scheme involved subdividing part of the reserve into lots which were then settled & farmed by Indian graduates of industrial schools who were members of other bands. After an introduction to the inquiry that includes an overview of the previous handling of this issue, part II reviews the historical background of the File Hills farming colony and the protests & investigations relating to the colony since the 1940s. It then sets out the issues examined in the inquiry presents findings of their analysis. The issues include: whether the Crown's decision to undertake & implement the Scheme complied with treaty obligations and the Indian Act; whether the decision gave rise to a fiduciary obligation; the nature of any breaches by the Crown of the treaty or Act; and the appropriate criteria to compensate the First Nation for such breaches, if any. The report concludes with the Commission's decision regarding the First Nation's claim."--WorldCat.org.
