Abstract
"In February 1987, the Eel River Bar First Nation in New Brunswick submitted a specific claim that the Crown had violated the First Nation's treaty and riparian rights, provisions of the Indian Act, and its fiduciary obligations as a result of the construction of a dam on its reserve in 1963 and the consequent damages to the First Nation's fishery. This report contains findings and recommendations with regard to the merits of this claim. It begins with historical background, beginning with the Treaty of 1779 through the agreement to construct the dam and provide compensation. It then discusses the following issues with respect to the claim: the nature and extent of fishing rights; the authority for permit and expropriation of Eel River reserve land; and the fiduciary obligations of the Crown. It concludes with findings and a recommendation. Appendices include the text of the 1779 treaty and the 1970 agreement with the New Brunswick Water Authority."--WorldCat.org.
